What OSHA Requires

OSHA 29 CFR 1926.51 requires employers to provide “adequate and readily accessible” portable toilets at all work locations. Toilet facilities must be “nearby” for all workers, including mobile crews. OSHA guidance says “nearby” means prompt access and generally less than 10 minutes away.

OSHA vs. ANSI Standards

OSHA sets the legal minimum. ANSI/PSAI Z4.3 is a voluntary standard for portable sanitation at places of employment and can be a useful benchmark for servicing and site setup. For compliance, follow OSHA first and use ANSI/PSAI guidance as an added best-practice reference.

Sanitary Condition and Servicing

Portable toilets that are out of service or in unsanitary condition don’t count toward OSHA’s minimum. They’ve confirmed sanitation standards in a formal interpretation letter. OSHA has also said that weekly servicing is a good baseline.. Higher-use worksites may need more frequent service or additional units to keep facilities sanitary. Each visit should include waste-disposal, cleaning, and restocking toilet paper.

Handwashing Stations

Every construction jobsite needs handwashing stations near its portable restrooms. Under OSHA 29 CFR 1926.51(f):

  • Running water is required when it’s available on site.
  • If there’s no running water, hand sanitizer must be in each unit or a hand sanitizer station nearby.
  • When soap and water are provided, hand towels or air blowers must also be available.
  • Workers near chemicals need a washing facility close to their work stations.

Hand sanitizer is not a substitute when a water supply is available.

Placement Rules

Toilet facilities, including portable restrooms, must be less than a 10 minutes from active work areas. In high-rise work environments, ground-floor toilet rooms may not satisfy the OSHA rule if workers can’t get to them promptly.

  • Separate facilities for men and women are required unless units are single-occupancy and lock.

Types of Construction Portable Toilets

  • Standard non-flushing units: Most common on worksites. Single-occupancy and lockable. Counts as a unisex unit.
  • Urinals: Can add to the number of facilities on male-majority sites. No more than two-thirds of total facilities can be urinal-only.
  • ADA units: Wider inside, grab bars, and ramp access. Required when workers with disabilities are present.
  • Restroom trailers: Multi-stall with running water and climate control. Count toward OSHA minimums when properly serviced. Good for large sites or client visits.

Penalties for Non-Compliance

Serious violations under 29 CFR 1926.51 can cost up to $16,550 per violation. Willful or repeat violations can reach $165,514. Citations can affect your record, bids, and insurance rates. The most common Department of Labor citations are too few portable toilets for crew size, dirty units, missing hand washing stations, and restroom facilities that are too far from work areas.
